The Civil Procedure Rules require all courts to encourage litigants to use ADR and to facilitate its use. Alternative Dispute Resolution is a general term describing a variety of ways to resolve disputes without a conventional court trial. ADR has many benefits: it may save time and money, allow flexibility, offer more control, preserve relationships, offer confidentiality and provide finality.
SJ Berwin recognised that Alternative Dispute Resolution would become the commonplace alternative to traditional litigation in the UK, and it formed a special ADR Services Unit under the leadership of David I.
