Andrew Sutherland is a senior associate in the firm's Commerce & Technology Group. He specialises in technology and outsourcing transactions. Andrew joined SJ Berwin in 2007, having previously been at Electronic Data Systems (EDS), where he was a lead lawyer on new business transactions.
Andrew has spent a number of years working very closely with, and as an integral part of, bid teams tendering for and winning work in the highly competitive UK and global IT services and business process outsourcing sectors. He has particular experience of negotiating and managing large scale software and systems development, integration and implementation agreements, including development projects supporting wholesale business transformation and underpinned by project financing. He also has particular experience of medium to very large scale UK and multi-jurisdictional IT and business process outsourcing and offshoring projects, both in the public and the private sectors, and the management of complex outsourcing and IT contracts after they have been won.
Andrew has acted on a number of highly complex transactions, including the £2.6 billion restructuring and renegotiation of EDS’ high profile IT outsourcing contracts with the Department for Work and Pensions, one of the largest outsourced IT estates in the world. He has also acted on the re-negotiation and extension of various multi-million pound IT and business process outsourcing contracts with the UK Government, the negotiation of IT outsourcing agreements with major international corporations in the confectionery and beverages, manufacturing and telecoms sectors, and the negotiation of a number of exit, transition and business and employee transfer agreements (both in first and second generation outsourcing scenarios).
