Dan Wheatley is an associate in the Reconstruction and Insolvency Group. He joined SJ Berwin in 2007 having previously worked in a large international law firm based in London. He also spent 6 months on secondment in the United States gaining first hand experience of Chapter 11 bankruptcy transactions.
Dan has experience with all aspects of restructuring and insolvency work with an emphasis on cross-border and non-contentious matters. He has particular expertise in consensual out of court restructurings and administrations. His additional experience in acting for lenders and borrowers in bilateral and syndicated lending allows him to focus on our clients’ key concerns when advising in relation to distressed debt and security enforcement matters.
Representative transactions include acting for:
- the borrowers in relation to a major restructuring of $500m receivables finance facilities structured under Islamic finance principles;
- Cognetas LLP as bond holder and shareholder in the restructuring of Danoptra Gaming Group;
- Hilton Hotels in relation to their ongoing development arrangements including non-disturbance agreements with lenders;
- a major private equity house in its contingency planning for a restructuring of its funds and advisory functions;
- a niche investment vehicle in its debt acquisition and subsequent restructuring in relation to an international mining company;
- the lenders in the restructuring of Thorn Nordic and its connected securitisation vehicle;
- the agent banks for the lenders to Eurotunnel.
