For more than 10 years, Nicolas Theys has specialised in advising companies in financial distress and, more generally, firms facing crisis situations.

His field of expertise encompasses out-of-court restructurings and workouts as well as court-assisted (mandat ad hoc and conciliation) restructuring proceedings designed to help firms avoid insolvency or bankruptcy. Such work has led him to advise French and International groups in selling off their underperforming subsidiaries or industrial units. He regularly serves as legal counsel for underperforming companies and also handles LBOs experiencing financial difficulties.

He also advises clients in connection with acquiring financially troubled companies (i.e. those not yet subject to bankruptcy proceedings or those under court-ordered bankruptcy protection or judicial reorganisation) and LBOs, and he took part in the first debt-equity swap operations in France.

Nicolas began his career in Paris, in 1994, before joining the law offices of S.G. Archibald, (member of the Arthur Andersen legal network) in 1997, as part of the restructuring team. Subsequently, he continued in the same practice area at Willkie Farr & Gallagher, from 2003 to 2005, before joining the Business Finance & Restructuring team at Weil, Gotschal & Manges.

Nicolas is a graduate of the University of Paris V, where he obtained post-graduate degrees in Contract and Civil Law, in 1994, and in Business Law, in 1993. He also graduated from the Institute of Comparative Law at the University of Paris II, in 1993. Nicolas is President of the French chapter of the Turnaround Management Association (TMA) and he is also a member of INSOL International as well as the French Association of Bankruptcy Practitioners (IFPPC).

Nicolas joined SJ Berwin as a partner in February 2008.

Nicolas is bilingual in English and French and has been a member of the Paris Bar since 1997.
