We enjoy a formidable reputation in all aspects of EU & competition-related litigation, including judicial review proceedings both at EU and national level.  Litigation is a core part of our practice and all litigation is dealt with within our EU & Competition department.

We have substantial experience representing clients in contentious competition cases before national courts and tribunals in Germany and across Europe. This includes appeals against decisions made by competition authorities and by sector regulators.  We are regularly instructed to represent clients before the Court of First Instance and the European Court of Justice.

SJ Berwin is also at the forefront of private enforcement of competition law, an area that is fast-developing in Europe.  In particular, we have acted for clients in relation to claims for damages for infringement of EU and national competition rules, including ‘follow-on’ actions and claims in multiple jurisdictions giving rise to conflict of laws.  Where appropriate, we work with our in-house mediation and international arbitration specialists to ensure that our clients can achieve the most favourable outcome through alternative dispute resolution.

Our experience has involved acting for a number of different parties - corporates, associations, private litigants and governments. We regularly assist our clients in challenging or intervening in support of decisions made by the European Commission, national competition authorities and sector regulators; actions against Member States for unlawful grant of state aid, before the European Commission and before the European Court of Justice; actions against Member States for government action in breach of EC Treaty provisions; preliminary references by national courts to the European Court of Justice; claims for injunctions and damages; judicial review of decisions by public bodies; defence of criminal prosecutions for alleged cartel conduct, and mediation and arbitration to resolve competition-related disputes.
