Asset Based Lending ABL Lite: the way forward?

The ABL and Reconstruction & Insolvency Group at SJ Berwin LLP has pleasure in inviting you to a debate on the opportunities and challenges of introducing lighter controls into Asset Based Lending.

The decision in Spectrum Plus has given further impetus to the movement of discounting and asset based lending products into the mainstream of financing. Nonetheless the penetration of ABL into the UK market is significantly lower than in the USA. US facility documentation imposes lighter controls on compliant borrowers. Anecdotal evidence from the UK suggests that control issues discourage acceptance of ABL by borrowers with stronger covenants. Is lighter control a key to greater adoption? If so, what challenges does it pose?
