On 2 May 2007 the House of Lords decided that the photographic images of the wedding of Michael Douglas and Catherine Zeta-Jones were protected by the law of confidentiality. Lord Hoffmann said the information could be protected because "it was information of commercial value over which the Douglases had sufficient control to enable them to impose an obligation of confidence".

OK! had also claimed that Hello! were liable for the tort of causing loss by unlawful means by publishing “spoiler” photographs of the wedding. The House of Lords gave useful guidance on this tort and confirmed that it is a distinct and separate tort from that of inducing breach of contract. At this seminar Richard Slowe of SJ Berwin and counsel from Essex Court Chambers, (all of whom represented OK! in the House of Lords) will discuss this important decision and its implications.
