Litigation Forum: Strategies for Winning at Mediation

The seminar will consider the role of the mediation advocate and the techniques that can be used to get the most out of mediation. The seminar will also consider the mediation landscape since Halsey v Milton Keynes General NHS Trust including recent case law and the update to the CPR.

Background

Parties often underestimate the power of the mediation process because it is "voluntary". The dangers of doing so are manifest and significant sums can be lost or gained as a result of utilising the range of techniques available to the mediation advocate. This session views matters from the viewpoint of the parties – how to maximise the chances of success. Unwilling participants also need to be aware of the potential consequences of refusing to mediate or take the process seriously.

The programme will start with Hilton Mervis who will provide you with an overview of effective techniques and practical tips for success in mediation.

Shaistah Akhtar will then go on to consider recent case law and the update to the CPR and their impact on a party's refusal to mediate.
