Background
In the context of market abuse, the FSA has recently confirmed that going forward, it expects to bring more criminal prosecutions than it has done to date. The prospect of more criminal prosecutions at a time when the Market Abuse Directive is not yet fully understood will have wide-ranging implications for market participants. Not least because potential criminality in a trading context is likely to make it easier for the United States, in appropriate cases, to use the "fast-track" extradition procedure. The emergence of London as an eminent financial centre and the globalisation of the trading economy mean that an appreciation of these risks and corresponding risk management are now more important than ever before.
