Litigation Forum: I Can't Get No Satisfaction!

The first Litigation Forum, held in November 2001, addressed the issue of how to get paid without going all the way to trial. This event continues that theme by looking at what claimants can do to make sure that defendants pay once the claimant has successfully sued. All too often, claimants may focus on their legal rights and ignore the practicalities of forcing a "judgment debtor" to do as the court has ordered and pay up.

The following issues will be covered:

  • The circumstances in which the court will freeze a defendant's bank accounts and assets even before the claimant has issued proceedings (what was previously known as the Mareva Injunction).
  • What different ways of (legal) enforcement are available, including an explanation of current and revised procedures using bailiffs, charging orders and garnishee proceedings.
  • Review of recent important cases.
