- Is it the mediator’s job actively to promote a settlement between the parties?
- Is the mediator influenced in his or her role by the effect that settling might or might not have on his or her reputation? If so, how might this affect the process?
- Does the mediator have a stake in ensuring fairness of outcome? What is the mediator’s stake in relation to a settlement which appears to be unfair or a miscarriage of justice?
- Does the mediator have a stake in an outcome that covers up a criminal act or is itself a result of criminal behaviour?
- Does the mediator have a stake in ensuring the sustainability and enforceability of agreed terms?
- Would a mediator’s fee that is based on success or geared to the level of settlement be appropriate?
Training
