The Terminator
Wednesday 18th October 2006
at 10 Queen Street Place London EC4R 1BE
Background
The statutory dispute resolution procedures have now been in force for two years and case law on the application of the rules is coming through thick and fast. It seems that rather than promoting internal dispute resolution by encouraging the disgruntled employer or employee to talk, the rules are actually giving the parties even more to argue about in the first place. We will be looking at how the dismissal and disciplinary procedures and the grievance procedures are working in practice, and how to deal with the tricky issues which can arise when following the procedures.

Programme
In this seminar, we will be reviewing the application of the statutory dispute resolution procedures, and analysing the case law resulting from the application of these rules. In particular, we will give practical guidance on:
- what a grievance is
- how to manage an inter connected disciplinary and grievance process
- how the statutory procedures inter-relate with the existing employment rights, for example, the right not to be unfairly dismissed
- what the sanctions are for a failure to follow the procedures
