The GE/Honeywell Case

On 14 December 2005, the European Court is at last expected to give its long-awaited ruling in the GE/Honeywell case.

We plan to do a quick analysis and a short early evening seminar the following Monday, 19 December, looking at its implications for future deals.

Our principal speakers will be Christophe Humpe from our Brussels office and one of the best-known competition economists, Dr Mike Walker, of Charles River. We also hope to have input from an experienced and knowledgeable audience, including representatives from some of the competition authorities.


Background
The key issues and questions being considered are:

  • What does this mean for deals between companies in neighbouring markets (i.e. so-called "conglomerate" effects rather than direct horizontal overlaps)?
  • Are more or less of these deals likely to go to Phase 2 - or even be blocked?
  • What does the case have to say about the burden on the Commission to prove its case?
  • Will the court reign in the Commission's margin of discretion?
