Background
In these times of rapid change and development, it is not uncommon for an employee's contract of employment, signed at the commencement of employment, to become out of date or inconsistent with his or her current role, responsibilities or benefits. In some cases the interests of the business and those of the employee may not coincide and it is these changes which can lead not only to potential practical difficulties, but also to legal claims and financial compensation. In this seminar, we will be looking at how to deal with changes to terms and conditions of employment where the employee in question is not necessarily inclined to consent, and whether it is ever possible to impose unilateral changes to terms and conditions of employment.

Programme

  • Consideration of the flexibility which can be provided for upfront in the terms and conditions of employment, and the possible limits on this flexibility
  • Legal and practical tips on managing a change exercise, including:
    • what happens if an employee refuses to agree to changes proposed by the employer?
    • when, if ever, is it possible to impose unilateral changes to terms and conditions?
    • when will a proposed change in terms and conditions amount to a redundancy situation?
    • how to minimise the risks of subsequent claims for unfair dismissal and/or discrimination
