Background
The European Court of Justice has decided that, in certain European cases, if you are sued overseas in the face of an English jurisdiction clause, you must go and fight those proceedings.

No longer can the English court stop the foreigner from continuing them. This makes litigation more expensive, but there may be ways around it.

We will also take the opportunity to review the current position concerning anti-suit injunctions.

Finally we will look generally at inserting jurisdiction clauses when doing business across different countries.
